On March 14, 2023, the New Jersey Department of Environmental Protection (NJDEP) issued Administrative Order 2023-08 regarding the Natural Resource Restoration Policy, also known as the Natural Resource Damage (NRD) program. “Natural resources” is a broad term that encompass land, water, ground water, vegetation, biota, wildlife, aquatic life and air. Prior to this order, the NJDEP’s NRD program has pursued damages on a select few properties with limited transparency and has been largely disconnected from the remediation process.
The order directs that the NJDEP should pursue the assessment and restoration of natural resources, using the combined efforts of the Office of Natural Resource Restoration and a new Natural Resource Restoration Advisory Council. In addition to input from the State, the NJDEP has promised that the process will also engage in developing collaborative solutions with Responsible Parties and seek input from LSRPs. With this new order, the NRD program is promised to be reawakened with updated procedures and potentially long-reaching expensive implications for responsible parties.
